General Terms and Conditions (GTC) of the Bethanien Association

Purchase of tickets for Lumeum events

1. Scope

1.1 These General Terms and Conditions (GTC) apply to all contracts between the Bethanien Association (hereinafter referred to as ‘Association’) and the customer in connection with the purchase of tickets for events at Lumeum.

1.2 By purchasing a ticket, the customer accepts these GTC. Deviating terms and conditions of the customer shall not be recognised unless the Association has expressly agreed to them in writing.

2. Organiser

2.1 The organiser of Lumeum events is the Bethanien Association, Bethanienstrasse 3, 6066 St. Niklausen OW.

2.2 The Association is responsible for the organisation and implementation of the events and is the contractual partner of the customer when purchasing tickets.

3. Ticket sales

3.1 Tickets are sold exclusively through the sales channels and partners authorised by the association.

3.2 The association reserves the right to limit the number of tickets per purchaser.

4. Prices and terms of payment

4.1 The prices stated at the time of conclusion of the contract apply. All prices include statutory value added tax.

4.2 Depending on the sales channel, payment can be made by bank transfer, credit card or other payment methods offered.

4.3 The total price of the order is due and payable immediately.

5. Delivery of tickets

5.1 Depending on the sales channel, tickets will be delivered by email (Print@Home, mobile tickets), by post or left at the box office.

5.2 In the case of electronic tickets, the customer is responsible for printing them out or making them available on a mobile device.

6. Changes to dates

6.1 The association reserves the right to change the programme, date, time or location of the event.

6.2 In the event of significant changes, the customer will be informed where possible. Notification will be sent to the email address provided when placing the order.

7. Admission and house rules

7.1 The association exercises house rules during the event. Supervisory staff are authorised to issue instructions, which must be followed.

7.2 The association may refuse admission to or exclude from the event any persons who violate the house rules, without this giving rise to any claim for a refund of the admission price.

8. Liability

8.1 The association shall be liable without limitation for intent and gross negligence and in accordance with the Product Liability Act.

8.2 The association shall only be liable for slight negligence in the event of a breach of a material contractual obligation and only for foreseeable, typical damages. In the event of slight negligence, liability shall be limited to the ticket price.

8.3 Attendance at the event is at your own risk.

9. Special provisions regarding ticket purchases

9.1 Conclusion of contract: By ordering a ticket through an official sales channel, the customer enters into a contract with Verein Bethanien for the service specified on the ticket.

9.2 Admission policy: Admission is only granted if all requirements (e.g. age limit, safety conditions) are met. Infants under the age of 6 are excluded for health reasons, unless otherwise communicated.

9.3 Tickets and checks: Only valid, legible tickets (QR/barcode) grant admission. The first scan counts. Copying, duplicating or altering tickets is prohibited. No claims will be accepted for lost or damaged tickets.

9.4 Personalisation: In the case of personalised tickets, only the person named on the ticket is entitled to admission. Incorrect information is the responsibility of the customer.

9.5 Recordings: Audio, image or video recordings during events are prohibited without written permission.

9.6 Safety requirements: The customer undertakes to comply with all safety and implementation requirements. Violations may result in exclusion.

9.7 Returns, exchanges, cancellations: Tickets cannot be exchanged under any circumstances. Tickets remain valid in the event of a change of date or venue. No refunds will be given in the event of cancellation due to force majeure (pandemic, war, etc.). Refunds (if any): only face value, max. reduction of 10% possible.

9.8 Resale: Commercial trading in tickets is prohibited. Violations will result in withdrawal of the service and possible claims for damages.

9.9 Data protection [&] marketing: By making a purchase, the customer agrees that their data may be used for advertising purposes and, if necessary, passed on to selected third-party partners (e.g. from the media, tourism, education, insurance sectors, etc.). This consent may be revoked at any time by sending an email to info@lumeum.ch.

10. Cloakroom and luggage

10.1 The association may stipulate that certain items may not be taken into the event rooms and must be left in the cloakroom.

10.2 The cloakroom requirement will be determined and communicated on a case-by-case basis. A fee may be charged for storage.

10.3 The Association is not liable for loss or damage to cloakroom items or valuables, unless the damage is due to intent or gross negligence.

11. Prohibition of bringing food and beverages

11.1 Bringing food and beverages to events is generally not permitted, unless expressly communicated otherwise.

11.2 In the event of non-compliance, access may be denied or exclusion from the event may occur without any entitlement to a refund.

12. Place of jurisdiction and applicable law

12.1 Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

12.2 The place of performance and jurisdiction for all disputes arising from the contractual relationship is the registered office of the association, provided that the customer is a merchant, a legal entity under public law or a special fund under public law.

13. Severability clause

13.1 Should individual provisions of these General Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

13.2 The invalid or unenforceable provision shall be replaced by a provision that comes closest to the economic purpose of the invalid provision.

14. Donations

14.1 Voluntary contributions to the ‘Niklaus [&] Dorothee Alive’ project and the renovation of the monastery complex may be deducted from the donors' income or profits in accordance with Art. 35a para. 1–3 (natural persons) or Art. 79 lit. c (legal entities) of the Obwalden Tax Act.

14.2 The deduction is limited to 20% of income for natural persons and 20% of net profit for legal entities.

15. Amendments to the General Terms and Conditions

15.1 The Association reserves the right to amend these General Terms and Conditions at any time without giving reasons.

15.2 The amended terms and conditions will be sent to the customer by email or published on the website. They shall be deemed accepted if the customer does not object within 14 days of publication.
